“Financial Literacy Month Challenge” Sweepstakes

NO PURCHASE IS NECESSARY TO ENTER OR WIN THE Financial Literacy Month Challenge Sweepstakes (the “Sweepstakes”). A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING. The Sweepstakes period begins April 1, 2013, 12:00:01 a.m. Eastern Time (ET) and ends after the final drawing on May 6, 2013 (“Sweepstakes Period”).

Who may enter: The Sweepstakes is open to legal residents of the 50 United States and District of Columbia who are (i) at least 18 years of age at the date of entry, (ii) existing Higher One Cardmembers, AND (iii) registered members of One For Your Money (“Eligible Cardmembers”). Employees, officers, and directors (including immediate family members and members of the same household) of Higher One, Inc. (“Sponsor”), and its parent companies, subsidiaries, affiliates, suppliers, advertising and promotion agencies, and any and all other companies associated with this Sweepstakes are not eligible to participate.

How to enter: You may enter by (1) registering as a One For Your Money member at http://www.startwithchange.com AND writing a comment on any “Challenge Week” blog post at http://www.startwithchange.com between April 1, 2013 12:00:01 a.m .ET and April 30, 2013 11:59:59 p.m. ET; or by (2) following @MoneyTalkMary on Twitter (www.twitter.com/moneytalkmary) AND tweeting @MoneyTalkMary using the hashtag “#HigherOneChallenge”. Entries must be received no later than 11:59:59 p.m. Eastern Time (ET) on the last day of each respective drawing period as described below under “Winning.”

Alternate form of entry: You may enter the Sweepstakes by mail without registering as a One For Your Money member and writing a blog post comment as described above. Eligible Cardmembers may enter by sending a 3 x 5 card containing the following information: your name, address, city, state, zip code, name of college or university attending and daytime telephone number in a hand-addressed U.S. first-class, postage-paid envelope to: Financial Literacy Month Challenge Sweepstakes, 115 Munson Street, New Haven, CT 06511. All mail-in entries must be original and handwritten and must be mailed separately (limit one entry per outer mailing envelope). Photocopies or mechanically or electronically reproduced entries will be disqualified. Mail-in entries postmarked during each respective drawing period, as described below under “Winning,” and received by the Tuesday after such drawing period will be valid. All entries become the property of the Sponsor and will not be returned. Sponsor assumes no responsibility for lost, late, illegible, incomplete, damaged, postage due or misdirected surveys or mailed entries, which will be void, or for any problems or technical malfunction of any telephone network or lines, computer equipment, software, failure of any email service or any combination thereof including without limitation any damage to entrant’s or any other person’s computer resulting from completion of the survey or participation in this promotion. Entries generated by script, macro or other automated or mechanical means are void.

Winning: Nine (9) weekly winners will be selected by four (4) random drawings during the Sweepstakes Period. Drawings will occur on 4/11/13, 4/18/13, 4/25/13 and 5/6/13, with each respective drawing including only the valid entries received between 4/1/12-4/07/13, 4/08/13-4/14/13, 4/15/13-4/21/13 and 4/22/13-4/30/13, respectively. Each winner must meet all eligibility requirements set forth in these rules to qualify for his or her prize. Odds of winning depend on the total number of eligible entries received for each drawing.

Prize Package: 36 gift cards will be distributed to the winners of the Sweepstakes via U.S. Postal Service or UPS. The total value of all prizes awarded will be nine hundred U.S. dollars ($900).

Claiming Prize: Sponsor will use the e-mail address specified in the registered user’s account information to contact each winner after each drawing.  If there is a dispute as to the identity of an online entrant, the prize will be awarded to the authorized account holder of the e-mail address.  The “authorized account holder” is defined as the natural person to whom the e-mail address is assigned by an internet service provider, online service provider or other organization (e.g., business, educational institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address.   Any attempt by any participant to obtain more entries by using multiple or different identities or email addresses or by any other method will void that participant’s entries, and that participant may be disqualified at Sponsor’s sole discretion.  Any potential winner may be required to complete and return an affidavit of eligibility, liability and, where legal, publicity release within seven days of notification. In the event of noncompliance with these Official Rules, if the entrant does not respond or cannot be contacted at the address associated with his or her account or indicated on his or her entry form, or if the notification is undeliverable, prize will be forfeited and an alternate winner may be selected. Prizes, in whole or in part, are non-transferable and no substitutions will be made except at Sponsor’s sole discretion. Acceptance of the prize constitutes permission and a waiver to use, copyright, reproduce, display and publish winner’s name, biographical information, image, photograph, voice and/or likeness by Sponsor and its agents, successors, and assigns for any purpose and in any media whatsoever, whether or not now known or hereafter developed, throughout the universe in perpetuity, without review or further compensation to entrant, except where prohibited by law. By participating, all entrants acknowledge compliance with and agree to be bound by these Official Rules, the decisions of Sponsor and judges which are final and binding in all respects, and all federal, state, and local laws and regulations.  Winners are responsible for all taxes and fees associated with prize receipt and/or use.

Conditions: Neither Sponsor nor its Agents are responsible for any: (a) lost, late, misdirected, damaged, forged, incomplete, illegible, garbled or postage-due entries or mail; (b) computer or network malfunction, or technical or human error; or (c) communication disruption, force majeure, or any other events or situations beyond the reasonable control of the Sponsor, including disruption related to data collection or transfer or any non-authorized intervention. If such malfunction, error, disruption or damage occurs, and impairs the administration, security, fairness, integrity or proper play of the Sweepstakes, Sponsor may, in its sole discretion, suspend or terminate the Sweepstakes. Persons found tampering with or abusing any aspect of this Sweepstakes, or whom Sponsor believes to be causing malfunction, error, disruption or damage will be disqualified. Sponsor reserves the right to void all entries made through any robotic, automatic, mechanical, programmed or similar entry duplication method and to disqualify any individual using such a method. By participating in this Sweepstakes, entrants hereby agree to release and hold Sponsor and each of their respective subsidiaries, affiliates, officers, directors, employees, agents and contractors, harmless from and against all losses, damages, liabilities, claims, actions, proceedings, settlements, or judgments arising out of or relating to entrant’s entry or participation in this Sweepstakes, participation in any Sweepstakes or prize related activity, or delivery, acceptance, use or misuse of any prizes awarded hereunder. IN NO EVENT WILL SPONSOR OR ANY OF ITS AGENTS BE LIABLE FOR ANY ACTIONS, CLAIMS, LIABILITIES OR DAMAGES OR LOSSES OF ANY KIND, INCLUDING DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL OR PUNITIVE DAMAGES, ARISING OUT OF YOUR PARTICIPATION IN THIS SWEEPSTAKES OR PRIZE RELATED ACTIVITIES. ALL PRIZES ARE PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. SOME JURISDICTIONS MAY NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES OR EXCLUSION OF IMPLIED WARRANTIES, SO SOME OF THE ABOVE LIMITATIONS OR EXCLUSIONS MAY NOT APPLY TO YOU. CHECK YOUR LOCAL LAWS FOR ANY RESTRICTIONS OR LIMITATIONS REGARDING THESE LIMITATIONS OR EXCLUSIONS.  Additionally, the winner will indemnify Sponsor, and its subsidiaries and affiliates, and its parent companies and each of such company’s officers, directors, employees and agents and any licensee of Sponsor against all claims, damages, liabilities, and expenses (including reasonable counsel fees and legal expenses) arising out of any breach of these terms.

Arbitration of Disputes: As a condition of participation in the Sweepstakes, entrants agree that any and all disputes which cannot be resolved between the parties, claims and causes of action arising out of or connected with the Sweepstakes, or any prizes awarded, or the determination of the winner shall be resolved individually, exclusively by arbitration in New Haven, Connecticut pursuant to the commercial arbitration rules of the American Arbitration Association, then in effect.  Further, in any such dispute, under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim punitive, incidental or consequential damages, or any other damages, including attorney’s fees or other such related costs of pursuing a claim and to have damages multiplied or otherwise increased.  All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrant and Sponsor in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the laws of the State of Connecticut, without giving effect to any choice of law or conflict of law rules (whether of the State of Connecticut or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of Connecticut. CAUTION. ANY ATTEMPT BY AN ENTRANT TO DELIBERATELY DAMAGE THE WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES IS A VIOLATION OF CRIMINAL AND CIVIL LAWS. SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT PERMITTED BY LAW.
